Purchasing on-line

Astutis online courses are delivered to you over the internet using the Absorb Learning Management System (LMS).

Upon receiving payment for your chosen course, if you are a new Astutis online learner your account will be created, you will be enrolled on the course and you will receive an email confirming your account logon details and another confirming enrolment on the course.

If you are an existing Astutis learner, upon receiving payment you will be enrolled on the course and you will receive an email confirming this.

Refunds

Due to the nature of the intellectual property within the course content Astutis does not offer refunds once you have been enrolled on a course and logged into the Absorb LMS.

A full refund is available within seven days providing you have not logged into the LMS, the refund will be done via the original mode of payment.

Course access

Astutis cannot guarantee that access to the course materials will be uninterrupted.

However the relationship between Astutis and Absorb LMS is such that Absorb LMS will use commercially reasonable efforts to make the LMS available 24 hours a day, 7 days a week, except for:

planned downtime, of which Absorb shall give us at least 8 hours’ notice and of which Astutis will inform you as soon as possible, bearing in mind the time difference between Canada, where Absorb are based, and the UK where Astutis Limited (Holding Company) are based; or
any unavailability caused by circumstances beyond Absorbs reasonable control, including without limitation, acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labour problems (other than those involving Absorbs employees), or Internet service provider failures or delays.
Upon allocation, online keys will remain valid for use for a period of 12 months. Once this period has expired any keys not allocated to a user will become invalid.

Exams

All exam fees or offers relating to exam fees included as part of the purchase price will expire for the NEBOSH Certificate level qualifications 12 months from purchase date and for NEBOSH Diploma level qualifications 36 months from purchase date. The purchase date will be deemed to be the date on which payment is received by the company for the agreed services.
Such exam fees or offers are only applicable for a single sitting per unit – any subsequent exams will be charged at an additional re-sit fee.

Intellectual property

All course materials are the property of Astutis and may not be copied, distributed, downloaded, uploaded, forwarded, published, reverse engineered, disassembled or used in any manner prejudicial to Astutis' interests and legal rights.

The downloading of single copies of pdf documents (course notes) is permitted only for personal study.

Any other use will infringe the intellectual property rights of Astutis for which Astutis reserves the rights to bring legal proceedings.

Currency of materials

All course content is created in accordance with the current course syllabus and reasonable efforts are made to ensure that the materials are updated promptly, in light of significant changes to legislation and guidance, or the requirements of the approving bodies.

Except as specifically provided for by law Astutis does not give any warranties, whether express or implied as to the currency, fitness or quality of the course materials or that the course materials are free from errors or defects.

Third party links

The course materials contain links to other web sites. Unless expressly stated, these web sites are not under the control of Astutis and Astutis assumes no responsibility for the content of such web sites and disclaim liability for any and all forms of loss or damage arising out of the use of them.

The inclusion of a link to another web site on an Astutis website, or within Astutis course materials, does not imply any endorsement of the web sites themselves or of those in control of them.

Data Protection / Privacy

Contact information provided during the purchase of the course and/or registering as a student will be held within the Astutis customer relationship management (CRM) system in a safe, confidential and secure environment.

Contact information may be used to supply further information about Astutis and our services. Users may opt-out of receiving future mailings by clicking the opt-out button on the mailer.

Astutis does not hold any sensitive personal information or financial details within its systems.

Astutis will not sell or rent your contact information to any third parties.

Limitation of Liability

Astutis will not be liable for any incorrect or consequential loss or damage arising out of or in connection with your use or inability to use the Absorb LMS Site or any of the course materials.

Law and Jurisdiction

These Terms and Conditions shall be governed by the laws of United Arab Emirates (UAE). Any dispute between the Parties relating to these Terms and Conditions shall fall within the jurisdiction of the courts of United Arab Emirates (UAE).
